NIPA has applied to HAL
for more funding to keep the important research by UTS going.
There have been some complaints recently about companies
using opposition company names for Google Adwords.
The Google user sees "Company A" but when they click on
the search result they are directed to "Company B".
14 July 2009. The Australian Competition and
Consumer Commission (ACCC) is currently running a case
against Google and The Trading Post in the Federal Court
of Australia on this very issue. Interestingly, the ACCC
has not pursued this matter on the basis of a breach of
a trade mark. Instead, the proceedings allege
misleading and deceptive conduct under
Section 52 of the Trade Practices Act 1974 (Cth).
A decision is expected to be handed down by the Court in
the coming months.

So it does not matter whether or not you have registered
you business name as a trademark, the issue is
misleading and deceptive conduct.
Google AdWords currently provides an online complaint
process whereby trade mark owners may report abuse of
their trade marks.
